Terms and Conditions of Sale
These Terms and Conditions apply to custom instruments commissioned directly from Iulius Guitars by private customers.

1. Custom Orders
Each Iulius guitar is individually designed and built by Giuliano Nicoletti according to specifications agreed with the customer.
A commission becomes confirmed when the order has been agreed and the initial 10% acompte has been received.
The initial payment is an acompte and represents a firm commitment to the commission by both the customer and Iulius Guitars. It is non-refundable in the event of cancellation by the customer, subject to applicable consumer law.
The instrument is defined before construction begins. Changes requested after this definition has been validated may be accepted when technically and practically possible and may result in additional costs or changes to the delivery schedule.
Because each instrument is individually made from natural materials, reasonable variations in colour, grain, figure, weight, and other natural characteristics are inherent to the work.
2. Price and Payment
The price of a custom Iulius guitar is €18,200, regardless of the model.
VAT is not applicable under Article 293 B of the French General Tax Code.
Payment is structured as follows:
10% acompte at order confirmation — non-refundable
40% at the start of construction
50% upon completion, before delivery
Payments are due within the timeframes stated on the corresponding invoices.
Any additional options or changes resulting in additional costs will be agreed with the customer before being carried out.
3. Build Time
Typical delivery is 6 to 8 months from the start of manual work.
An expected delivery period is communicated when the commission is accepted. Because each instrument is individually built, circumstances involving materials, construction, finishing, stabilization, or events outside reasonable control may affect the schedule.
The customer will be informed of any significant change to the expected delivery period.
4. Delivery
The instrument is released for collection or shipment once the final balance has been received.
Shipping and insurance are calculated separately according to destination.
Any applicable import duties, customs charges, local taxes, or similar charges in the destination country are the responsibility of the customer.
The method and conditions of shipment are agreed with the customer before dispatch.
5. Cancellation Before Delivery
Because each instrument is commissioned and made individually, cancellation by the customer after confirmation of the order does not entitle the customer to reimbursement of the initial 10% acompte.
If cancellation occurs after further payments have been made or after construction has begun, the conditions and any reimbursement will depend on the stage reached, work already completed, materials committed to the project, and applicable consumer law.
If Iulius Guitars is unable to complete the commissioned instrument, amounts paid by the customer for the uncompleted order will be refunded.
6. Right of Withdrawal and 7-Day Satisfaction Policy
Custom Iulius guitars are individually made according to specifications agreed with each customer. In accordance with applicable French consumer law, the statutory right of withdrawal normally applicable to distance purchases does not apply to goods made to the consumer’s specifications or clearly personalized.
Iulius Guitars nevertheless offers customers an additional 7-day satisfaction period.
If, after receiving the completed instrument, the customer decides that the guitar is not right for them, the customer must notify Iulius Guitars in writing within 7 calendar days of delivery.
The instrument must then be returned to Iulius Guitars in its original condition, together with its case, documentation, accessories, and all other items supplied with it.
Return shipping, appropriate packaging, full insurance, customs charges, and any other costs associated with returning the instrument are the responsibility of the customer.
After its return, the instrument will be offered for resale by Iulius Guitars.
Once the instrument has been resold and Iulius Guitars has received full payment from the new buyer, the original customer will receive a refund equal to 80% of the original instrument price.
Original shipping, insurance, customs duties, taxes, and other costs associated with the original delivery are not included in the refund.
If the returned instrument has been damaged, modified, or shows wear beyond what can reasonably result from evaluation during the 7-day period, the cost of restoring the instrument and any resulting loss in value may be deducted from the refund.
The timing of resale cannot be guaranteed. The refund under this voluntary satisfaction policy becomes due only after the instrument has been resold and full payment from the new buyer has been received.
This 7-day satisfaction policy is a voluntary commercial provision offered by Iulius Guitars. It is separate from, and does not limit, the customer’s statutory rights concerning defective or non-conforming goods.
7. Legal Guarantees
Customers purchasing as consumers benefit from the statutory guarantees provided by French law, independently of the Iulius Guitars commercial warranty and satisfaction policy.
These include the legal guarantee of conformity, under Articles L.217-3 and following of the French Consumer Code, and the legal guarantee against hidden defects, under Articles 1641 and following of the French Civil Code.
For a new instrument, the legal guarantee of conformity may be invoked for defects of conformity appearing within two years from delivery, under the conditions established by French law.
These statutory rights cannot be excluded or reduced by these Terms and Conditions, the Iulius Guitars commercial warranty, or the voluntary satisfaction policy described above.
8. Iulius Guitars Commercial Warranty
In addition to the statutory legal guarantees, each new Iulius guitar is covered by a 5-year Iulius Guitars commercial warranty for the original owner, starting from the date of delivery.
The warranty covers defects in materials and workmanship under normal use.
The warranty does not cover:
normal wear and tear
routine maintenance, setup adjustments, or string replacement
damage resulting from misuse, accident, neglect, or improper storage
damage related to improper humidity, temperature extremes, or lack of appropriate care
modifications or repairs performed by third parties without prior approval from Iulius Guitars
Warranty claims should first be submitted directly to Iulius Guitars for evaluation.
Warranty service is provided through the Iulius workshop. Shipping and insurance costs related to the commercial warranty are the responsibility of the owner, except where otherwise required by applicable law.
The Iulius Guitars commercial warranty is provided in addition to the customer’s statutory rights and does not limit or replace them.
9. Complaints and Consumer Mediation

If a consumer dispute cannot be resolved directly, the customer may use the consumer mediation service designated by Iulius Guitars, in accordance with applicable French consumer law.
Personal information provided in connection with an inquiry or commission is used for managing the customer relationship, order, payment, delivery, and related legal or administrative obligations.

11. Applicable Law
These Terms and Conditions and contracts concluded with Iulius Guitars are governed by French law.
Nothing in these Terms and Conditions limits any mandatory rights or protections available to consumers under applicable law.
